El 6 de octubre de 2014, la Superintendencia de la Información y Comunicación (Supercom) sancionó a la estación televisiva Canal Uno con dos multas, que suman USD 10.200 dólares, y una amonestación escrita por supuestamente incurrir en infracciones, contempladas en los artículos 30 numeral 4; 32 y 10 numeral 3, letra d) de la Ley Orgánica de Comunicación (LOC), referentes a la información de circulación restringida, a la protección integral de los niños y adolescentes y a las normas deontológicas.
La entidad de control -que actuó de oficio tras un reporte de la intendencia nacional- determinó que en el programa ‘Noticiero Uno’ de Canal Uno permitió la “libre circulación de información que violenta el derecho a la dignidad e imagen de una niña”, por una nota emitida el 9 de junio, en donde se incluyeron imágenes y nombres propios, permitiendo “la individualización e identificación de la niña”, según consta en la resolución. Por este motivo, el organismo impuso una multa de 20 remuneraciones básicas. De igual forma, la Supercom impuso una multa adicional de 10 sueldos básicos por “no privilegiar la protección integral de las niñas, niños y adolescentes, especialmente contra la revictimización”.
Así también, emitió una amonestación escrita al medio, previniéndole que mejore sus prácticas, por no evitar un tratamiento morboso a la información sobre crímenes, accidentes, catástrofes y otros eventos similares . La Supercom aseguró que “si bien la LOC no prevé una definición del término ‘morbo’, ‘su concepto es de conocimiento general’, por lo que el contenido de la noticia ‘tiende a provocar atracción por un hecho desagradable y violento’.
En la audiencia de sustanciación desarrollada el pasado 29 de septiembre, Rafael Ignacio Cuesta Caputti, representante del medio de comunicación rechazó una posible sanción por la revictimización. Sin embargo, reconoció que en dicho reportaje se reseñó el caso de una niña, de siete años, que aparentemente fue violada y que por un tiempo no menor a dos segundos apareció su rostro sin protección por un error involuntario. Ocurrió a las 06:03, pero según Cuesta Caputti, dicha equivocación fue corregida en las transmisiones siguientes.
TV station fined with ten thousand dollars and admonished by ‘morbid’ content
On October 6th, 2014, the Superintendence of Information and Communication (Supercom) sanctioned the TV station Canal Uno with two fines of USD 10,200 dollars and a written reprimand for allegedly violations to the Article 30 paragraph 4; 32 and 10 paragraph 3, letter d) of the Communications Law (LOC), concerning the report of restricted information about children, teenagers and also ethical standards.
The control entity which acted on its own initiative, after an internal report, found that the News program “Noticiero Uno” allowed the «free flow of information that violates the right to dignity and image of a girl». According to the Supercom, the note was issued on June 9, where images and names were included, allowing «individualization and identification of the child,» as stated in the resolution. For this reason, the agency fined the media outlet with 20 basic salaries. In addition to that, the entity imposed an additional fine of 10 basic salaries for «not giving priority to the integral protection of children and adolescents, especially against victimization.»
The control entity also issued a written reprimand against the TV Channel warning them to improve their practices, for not preventing a morbid treatment to the information about crimes, accidents, disasters and other similar events. The Supercom said that «although the LOC does not provide a definition of the term ‘morbid’, this ‘concept is common knowledge’, so the content of the news’ tends to cause an unpleasant and violent act.»
At the hearing developed last September 29th, Rafael Ignacio Cuesta Caputi, media representative rejected a possible penalty for revictimization. However, he acknowledged that in the news report the face of a girl, aged seven, who apparently was raped, was shown unprotected for less than 2 seconds by an inadvertent error outlined. It happened at 06:03, but according Cuesta Caputi, this mistake was corrected in subsequent transmissions
