El 10 de febrero de 2012, los jueces de la reciente conformada Sala Penal de la Corte Nacional de Justicia y encargada de resolver, en casación, la sentencia que condenó, por injurias, al ex articulista y los directivos de diario El Universo a tres años de prisión y al pago indemnizatorio de $40 millones, fijó para este 15 de febrero la nueva fecha para la audiencia de casación.
Horas antes de esta decisión, esta misma sala había resuelto suspender la audiencia, cuya fecha, fue fijada anteriormente por el antiguo tribunal saliente que se excusó de resolver la causa.
FUNDAMEDIOS conoció de primera mano que la defensa de diario El Universo ya fue notificada con la nueva fecha fijada para este 15 de febrero de 2012, a las 09:00.
Esta mañana el Juez Wilson Merino anunció que decidieron suspender la audiencia porque el sorteo de la causa se realizó hace «apenas 12 horas y hace solo una, se sorteó al juez ponente», por lo que «oportunamente se comunicará en las casillas judiciales el día y la hora en que la diligencia tendrá lugar», apuntó Merino, ante la presencia del presidente Rafal Correa, los abogados de la partes y los medios de comunicación.
Desde muy temprano, la Secretaría Nacional de Comunicación publicó en su cuenta Twitter que la audiencia de casación se podría seguir en vivo desde las 09:00. Incluso, el presidente Rafael Correa manifestó, tras conocer la decisión de los jueces, que hasta tuvo que suspender un viaje a Cuba para asistir a esta audiencia fallida.
La nueva sala que tratará el caso de diario El Universo recayó en manos de los jueces Wilson Merino, Paúl Íñiguez y Jorge Blum, tras el sorteo, a puerta cerrada, realizado un día antes en horas de la tarde.
Este sorteo fue cuestionado por el abogado de la compañía El Universo, Xavier Zavala Egas, quien comentó que este no se llevó a cabo conforme lo dicta la ley.
Según Zavala, «la ley establece que por cada causa ingresada se sortean tres jueces y ayer no se hizo así. Los ministros de esa sala se dividieron en tres tribunales, escogidos a dedo y a esos tribunales se le asignaron causas supuestamente por sorteo, que se hizo de forma manual.
El abogado apuntó, además, que los nuevos jueces han tenido una decisión acertada al suspender la audiencia, pero, cree que hay un símil con la agenda política del Presidente, quien quiere cerrar el caso lo antes posible, por lo que dijo, el caso caminará mejor cuando apelen a instancias internacionales.
Esta es la segunda vez que los jueces suspenden una audiencia de casación. La primera ocurrió el pasado 24 de enero de este año porque no se pudo conformar la sala .
Cabe recordar que el pasado 22 de marzo de 2011, el presidente Rafael Correa demandó penalmente al ex articulista de diario El Universo, Emilio Palacio; a sus tres directivos; Carlos, César y Nicolás Pérez y a la compañía anónima El Universo por $80 millones, tras la publicación del artículo de opinión «No a las mentiras» de autoría de Palacio, en relación al papel del Jefe de Estado en los hechos ocurridos el pasado 30 de septiembre.
Este caso recibió su primera sentencia en primera instancia el pasado 20 de julio de 2010. Ese día, un juez temporal declaró culpable de injurias a Palacio y a los directivos del periódico por autoría coadyuvante y ordenó tres años de prisión para cada uno y al pago de $40 millones. Esta condena que fue ratificada en segunda instancia.
Tribunal sets new date for the review of facts in El Universo case, after having decided to suspend it
On 10 February 2012, the judges of the newly formed Criminal Division of the National Court of Justice,in charge of reviewing an appeal for the review of facts concerning the sentence that convicted a former feature writer and the directors of the newspaper ElUniverso to three years in prison and the payment of $40 million in damages, set the 15 February as the new date for the hearing.
A few hours before making this decision, this same division had decided to suspend the hearing. The date for this had been set by the previous members of the tribunal, who excused themselves from hearing the case.
FUNDAMEDIOS got first-hand knowledge that El Universo’s defense attorneys have already been notified about the new date, set for 15 February 2012 at 9:00 am.
This morning, Judge Wilson Merino announced before President Rafael Correa, both parties’ attorneys and the media, that they had decided to suspend the hearing because the drawing of lots to determine the allocation of cases had taken place “just 12 hours ago, and the decision about who would be the judge-rapporteur, just one hour before”. Therefore, he said “the day and time in which the proceeding will take place shall be informed at the proper time through the judicial boxes”.
The National Communication Department published very early in its Twitter account that it would be possible to follow the proceedings live from 9:00 am. After hearing the judges’ decision, President Correa announced that he had even had to suspend a trip to Cuba to attend the failed hearing.
The new division that will deal with the case involving El Universo case is constituted byjudges Wilson Merino, PaúlÍñiguez and Jorge Blum. This was decided by a secret drawing of lots that took place in the afternoon a day before.
The draw was questioned by El Universo’s attorney Xavier Zavala Egas, who commented that it was not doneaccordingtowhatisestablishedbylaw.
Zavalastated that “the law establishes that lots to choose three judges should be drawn for each of the cases admitted, and this was not done yesterday.The division’s ministers were handpicked to make up three tribunals, and those tribunals were allocated cases, allegedly by drawing lots manually.
The lawyer also pointed out that the judges were right to suspend the hearing, but he believes there is a similitude with the political agenda of the president, who wants to close the case as soon as possible. He added that the case will be dealt with in a better way when they appeal to international organizations.
This is the second time the judges suspend a hearing for the review of facts.The first time was on 24 January because they were not able to constitute the tribunal.
It is worth remembering that on 22 March 2011, President Rafael Correa sued former ElUniverso feature writer Emilio Palacio; its three directors, Carlos, César and Nicolás Pérez, and the company El Universo for $80 million, after the opinion article “No a lasmentiras” was published. The article, which was written by Palacio, referred to the president’s actions during the events of 30 September 2010.
On 20 July 2011, in a first instance ruling, a temporary judge declared Palacio guilty of offences against the president and the newspaper’s directors as contributing authors of the crime. He convicted all of them to three years in prison and to the payment of $40 million in damages. This sentence was ratified in a second instance.
