El 24 de noviembre de 2011, la policía ecuatoriana detuvo a un ciudadano sospechoso de haber amenazado de muerte al presidente Rafael Correa mediante la red social Twitter. La noticia se conoció a través de esta misma red social, después de que José Serrano, ministro del interior, publicara, en su cuenta que: «Javier Genovez Solano, de 44 años de edad, es quien amenazó al Presidente, vía Twitter, acaba de ser aprehendido ya en la ciudad de Cuenca».
Genovez permaneció detenido cerca de 24 horas y fue liberado la tarde del 25 de noviembre, tras concluirse la audiencia de Control de Flagrancia. En ella, el ciudadano admitió haber sido el autor de los mensajes bajo el usuario @wacker600 y se disculpó públicamente ante el Presidente. «Fue un exabrupto, un error por parte mía», dijo.
Las investigaciones al usuario de Twitter iniciaron a partir de la denuncia hecha por el presidente Rafael Correa, durante su enlace sabatino del 19 de noviembre. Ese día, el Jefe de Estado aseguró que ha recibido amenazas de muerte a través de Twitter y como ejemplo, mencionó al usuario @wacker600, quien escribió: «¡Ave César, los que te vamos a matar!, ¡Ave MashiRafael, los que te vamos a matar te saludamos!». Otra cuenta que también fue investigada fue la del diseñador gráfico Irvin Joel Campos, bajo el nombre de usuario @Irvin_joel. Sin embargo, este último no tuvo orden de detención, según confirmó el ministro Serrano, en entrevista con la periodista Tania Tinoco de Ecuavisa.
Leonardo Barrezueta, viceministro de Seguridad Interna había señalado, en un boletín de prensa institucional, que todas las personas que mantienen una cuenta de Twitter o de Faceboock, están expuestas a recibir cualquier tipo de mensajes acorde a la actividad que se realiza, y que estas «son parte de la libertad de expresión que se vive con absoluta tranquilidad en el Ecuador». Esto sucedió cuando los peticionarios ante la CIDH, entre los que estaba FUNDAMEDIOS, denunciaron amenazas y acoso a través de las redes sociales .
Respecto a los comentarios que se vierten en las redes sociales, el presidente Rafael Correa manifestó que los defensores de la «libertad de expresión» quieren justificar el resentimiento en su contra a través de cualquier argumento. «Poder amenazar a una persona. ¿A eso le quieren llamar democracia? Bueno hagamos una consulta popular para ver si la gente está de acuerdo que las personas puedan amenazar, no solo al Presidente, sino a cualquiera de ustedes», dijo el Primer Mandatario, durante el Enlace Ciudadano No 247.
Twitterers are investigated while President speaks consultation on Freedom of Expression onsocial networks
On November 24, 2011 , The Ecuadorian police arrested a man suspected of threatening to kill the president Rafael Correa through the social network Twitter . The news came through the same social network , after Jose Serrano, Minister of the Interior , published in his mind: » Javier Solano Genovez , 44 years old, who threatened the President , via Twitter , just being already seized in the city of Cuenca. »
Genovez was detained about 24 hours and was released the evening of 25 November, after the hearing concluded Flagrancy Control . Leonardo Barrezueta , Deputy Minister of Internal Security had stated , in a press conference, that all persons who have a Twitter account or Faceboock are exposed to receive any type of message according to the activity being performed, and that these «They are part of the freedom of expression that exists with absolute confidence in Ecuador .» This happened when the petitioners to the IACHR , including FUNDAMEDIOS denounced threats and harassment through social networking.
Regarding the comments that poured in social networks , President Rafael Correa stated that the advocates of «free speech » want to justify resentment against them by any argument. «Being able to threaten a person . Is that what you want to call democracy? Well do a referendum to see if people agree that people can threaten not only the President , but to any of you , » the president said during his TV and radio broadcasting program No 247.
