Reciba un cordial saludo de quienes conformamos la Fundación Andina para la Observación y Estudio de Medios, Fundamedios. Mediante la presente nos permitimos exponerle las siguientes inquietudes: A dos meses del asesinato del periodista Fausto Valdiviezo, ocurrido el pasado 11 de abril de 2013 en Guayaquil, hay hechos que desconciertan y pistas que contradicen las versiones oficiales.
Una de ellas es que, a pesar de la detención de nueve personas presuntamente vinculadas con el crimen, aún no se han esclarecido; ni el móvil del mismo, ni la relación entre los sospechosos y la víctima.
Desconcierta, además, que tras el lamentable hecho, la Policía haya allanado la vivienda del comunicador y registrado sus pertenencias, como lo denunció su hijo el pasado 13 de abril a través de la red social Twitter. Hecho que fue corroborado por el abogado de la familia, Julio César Cueva, quien confirmó que se trataba un procedimiento “inusual”, tomando en cuenta que el asesinato ocurrió en otro lugar.
Asimismo, llama la atención que, a escasos cuatro días del asesinado del periodista, el ministro del interior José Serrano ya haya descartado públicamente una posible relación entre el crimen y a la actividad periodística que, desde hace 30 años, venía realizando Valdiviezo. Esto a pesar de que el 5 de junio del presente año, Luz América Moscoso, madre del comunicador dio nuevas pistas a la Fiscalía, tras declarar que su hijo, quien sufrió un atentado la noche anterior a su muerte, le había comentado que sospechaba de un directivo de un medio incautado, al cual Valdiviezo estaba investigando.
Antes, en una versión rendida el pasado 17 de mayo por Pedro César Jiménez Avelino, padrastro de la exesposa de Valdiviezo, afirmó que el periodista “sabía quién o quiénes podrían atentar contra su vida, pero no me indicó en ese momento de qué persona se trataba ni por qué motivo lo iban a hacer, solamente me dijo que estaban haciendo unas investigaciones y que lo que él sabía, iba a causar un revuelo social”. En esta versión también se nombró al directivo del medio incautado. Sin embargo, el abogado de la familia señaló que esta versión “sospechosamente la tenía la policía judicial y hasta el día de hoy no ha aparecido en el expediente”.
En otro hecho, el pasado 23 de mayo, y tras anunciarse la detención de siete personas presuntamente sospechosas del crimen, el Ministro Serrano aseguró, en rueda de prensa, que existe “una relación inusual” entre Valdiviezo y las personas detenidas que pertenecían a una banda de delincuentes que podría estar vinculada al tráfico de drogas, usura y trata de personas. En esa rueda de prensa el funcionario no supo explicar a los periodistas de qué se trataba el tipo de relación de la que hablaba, pero sí dejó entrever que Valdiviezo podría estar relacionado con los bandidos porque atravesaba una situación económica difícil. Estas declaraciones generaron el rechazo de los familiares del periodista, quienes enviaron una carta al Ministro para que esclareciera el tipo de relación del que hablaba el funcionario ya que consideraron que el término de “inusual”, ensuciaba la memoria de Valdiviezo.
Finalmente, tampoco es clara la relación que podría tener Ingrid Soraya León Bermúdez, identificada por la Policía como presunta autora intelectual del asesinato del periodista y su sobrina, quienes se habrían entregado de manera voluntaria el pasado 27 de mayo en medio de un confuso incidente en el que la sobrina habría intentado suplantar la identidad de su tía.
Por demás, sorprende en ese sentido, que no se haya establecido o por lo menos se haya informado, acerca del móvil que habría motivado al cometimiento del delito por parte de los acusados.
Por todo lo expuesto, como organización de la sociedad civil legalmente constituida y en cumplimiento de nuestro derecho constitucional a elevar peticiones a las autoridades y funcionarios públicos, solicitamos, Señor Fiscal:
- Que se conduzca las investigaciones con la debida transparencia y se ofrezca información veraz, verificada, contextualizada para que la prensa pueda informar de esa manera a los ciudadanos
- Que se llegue a los verdaderos culpables y a las verdaderas causas del asesinato del periodista Fausto Valdiviezo. Es, por demás, inadecuado que se haya desechado a priori los causales relacionados a la actividad periodística de la víctima, cuando existían testigos claves que habían señalado que Fausto Valdiviezo había señalado causas y culpables de cualquier hecho de violencia que podría darse en su contra. Esto no abona a la confianza en la transparencia de las investigaciones.
- Que no se intente manchar el nombre del periodista con insinuaciones que no se sustentan ni se explican de forma clara y que se piense en los familiares de la víctima que viven momentos muy difíciles.

The Andean Foundation for the Observancy and Study of the Media (FUNDAMEDIOS), kindly adress you in order to present some questions about facts regarding the death of journalists Fausto Valdivieso which are of our most serious concern:
It´s been two months since journalist Fausto Valdivieso was murdered on April 11 of 2013 in the city of Guayaquil. Up tp this date, there are some versions that contradict the official statements on the matter, as well as puzzling clues around the facts of the killing.
For instante, in spite of the fact that up untill now some nine people have been detained for being allegedly involved in the crime, it has not been clarified yet. Neither the motives nor the links of those arrested with the crime itself has been dully explained to the public.
It is baffling that after the crime took place, police agents searched Valdivieso´s home and registered his belongings. His son publicly denounced these actos on Twitter on April 13, as well as the family attorney, Julio Cesar Cueva, who indicated that this was an unusual procedure, considering that the murder someplace else.
It is quite strange that only after four days after the investigations began, José Serrano, Minister of the Internal Affairs, already made public statement discarding that the murder might be related to Mr. Valdivies´s 30 years of journalistic work. All these, in spite of the fact that on June 5, 2013, Valdivieso´s mother, Luz América Moscoso, provided new evidence to the Prosecutor´s Office, in which she indicated that his son had been shot the night before he was murdered, and that he feared that the Director of a State-administrated network that Valdivieso was investigating might be behind this attack.
Also, Mr. Pedro Jiménez Robalino, former father in law of Valdivieso, testified on May 17 indicating that “the journalist knew who where the ones that were threatening his life,but he did not mentioned any names or the reasons why he could be attacked.He just mentioned he was in the middle of some investigations that would cause a huge impact”. Mr. Jiménez Robalino also mentioned the name of the State-administrated network that Ms. Moscoso did in her statement. The family attorney indicated that “it is quite strange that these versions have not been included in the file that the Judicial Police is currently building for the case”.
Another strange fact is that on May 23 2013, after the arrest of seven people that were presumably related to the crime was made public, Minister Serrano held a press conference to talk about this case. Serrano indicated that “there was an unusual relationship between Valdivieso and the detainees, who where members of a criminal group that might have been involved in drug dealing, trafficking in persons, and usury. Nevertheless, the Minister failed to explain what kind of relationship he was talking about, but it was implied that Valdivieso might have been doing bussiness with the crooks. “He was in a precarious economic situation”, Serrano argued.
These statements were rejected by Valdivieso´s family. They sent a letter to Minister Serrano requesting that he clarifies his statement, in particular those related to the alleged “unusual relationship”, and complained that such affirmation stainted Valdiviesos image after death.
Finally, it is still unclear the links between detainee Soraya León Bermúdez and her niece with the crime.While the Police mentions León as the mastermind behind Valdivieso´s murder, and both her and her niece turned themselves in on May 27 past in the midst of a very confusing incident, it is, no conclusive evidence on their responsibility or motives behind Valdivieso´s murder have been made public.
Therefore, as a legally existing civil society organization, and excersising our right to address letters and requests to any public authority, we request to the Prosecutor General :
1. Investigations must be carried out with due transparency, providing the press and the public in general accurate, verified and contextualized information on this matter.
2. That the truth behind Fausto Valdivieso´s murder in unraveled, by determining the perpetrators and the motives behind the crime. It is inadequate that the possible relation between Valdivieso´s murder and his works as a journalist was discarded from the investigation prima facie, when some witnesses had told the Police that Valdivieso himself had indicated who could his possible attackers be, as well as the reasons for such attacks. These facts take credibility from the on-going investigation.
3. Public authorities must refrain from tainting Valdivieso´s memory with unfounded accusations or vague statements that are not even proved, considering in particular, the harsh and hurtful situation that his family is currently facing.
