Gobierno obstaculiza el normal funcionamiento de Fundamedios

El reciente traspaso del control administrativo a su principal agresor, la SECOM, solo es un hito más en una campaña de constante acoso y persecución hacia Fundamedios por parte del actual Gobierno ecuatoriano.

Por más de un año y medio, el Ministerio de Inclusión Económica y Social (MIES) no permite el registro de la directiva y nuevos socios de Fundamedios lo que claramente es una violación del derecho que tiene toda persona a asociarse libremente con personas de su elección para fines lícitos.

Desde el 09 de octubre de 2012, Fundamedios solicitó al MIES el registro de la directiva y la inclusión de un nuevo socio a la Fundación, sin embargo el Ministerio no ha dado paso a ello escudándose en un sinnúmero de trabas administrativas.

La primera es que no se pudo dar paso al  registro de un nuevo socio puesto que el periodo de la directiva había terminado y que debíamos presentar una auto convocatoria a la Asamblea General. Este pedido fue entregado al Ministerio.

Después de varios meses sin contestación a nuestro trámite, el 10 de mayo de 2013, nuestro abogado mantuvo una reunión con los funcionarios del MIES, donde solicitamos presentar en una sola petición la inclusión del nuevo socio y el registro de la nueva directiva, lo cual fue aceptado pero debía ser ingresado como un nuevo trámite.

El 17 de mayo del año pasado se cumplió con el nuevo requerimiento a la vez que se mantuvo una nueva reunión esta vez con  el Ab. Francisco Puente, quien se encargaba de estos trámites. Él no presentó observaciones a la solicitud realizada.

Un mes después, junio de 2013, el Ministerio con el oficio No. MIES-CZ-9-2013-2479-OF, dando largas a nuestro trámite, solicitó que, a) se adjunte copias de la nómina de socios de la Fundación y b) que se acredite la calidad de periodista del nuevo socio. Solicitud, por demás absurda, puesto que en el primer caso el Ministerio es  la autoridad encargada de llevar el registro de FUNDAMEDIOS y por lo tanto debían tener esa información. Sin embargo, el Ministerio justificó el pedido aduciendo que  los expedientes están incompletos puesto que fueron trasladados a un nuevo archivo y por lo tanto no contaban con esa información. En el segundo caso era aún más absurdo puesto que solicitaban que el nuevo socio justifique su calidad de periodista, citando un artículo de los estatutos que corresponde a los afiliados y no a los socios.

En el mismo mes de junio se mantuvo una reunión con el abogado Francisco Puente para explicarle que nosotros no teníamos una copia de la nómina de los socios actuales puesto que el MIES no da paso al ingreso del nuevo socio por lo que volveríamos a la misma situación por cuanto el MIES tenía los expedientes “incompletos” y no tenía acceso a esa información.

Solicitamos una solución y la segunda semana de agosto, el abogado Puente nos indicó que debíamos entregar  una copia certificada de la última directiva registrada donde conste la salida de la última socia.

El 17 de agosto del mismo año, Fundamedios volvió a ingresar la documentación y hasta el momento no hay respuesta alguna. Conocimos de fuentes extraoficiales que existen órdenes de sus superiores de no dar trámite al registro de la directiva de la Organización.

Apegados a la Ley, el pasado 05 de diciembre, y al no haber pronunciamiento del MIES o haber recibido notificación alguna por parte de esa institución,  ingresamos un último documento donde amparados en el artículo 28 de la Ley de Modernización del Estado que establece “todo reclamo, solicitud o pedido a una autoridad pública deberá ser resuelto en un término no mayor a quince días, contados a partir de la fecha de su presentación, salvo que una norma legal expresamente señale otro distinto…”  por lo tanto nos acogemos al silencio administrativo que dar por aceptada tácitamente nuestra petición.

Sin embargo, pocos días después, coincidencialmente, el 13 de diciembre, el MIES realiza el traspaso del control administrativo de Fundamedios hacia la SECOM, respondiendo a un “pedido” realizado en agosto del 2013.  Este traspaso de competencias se notifica a los afectados recién un mes después, el 16 de enero, luego de haber presentado al MIES una carta notificando que había transcurrido el tiempo suficiente para que se de paso al silencio administrativo.

Fundamedios ha sido constantemente atacado y descalificado por altos funcionarios del gobierno incluido el presidente Rafael Correa, así como también la utilización de los medios en manos del estado para desprestigiar las denuncias que realiza nuestra organización sobre las violaciones y limitaciones a la libertad de expresión y asociación que sufren los periodistas y ciudadanos del país. Government blocks the normal functioning of Fundamedios

The recent transfer of administrative control to the main aggressor, SECOM,(Secretariat of Communication) it’s just another step in the campaign of constant harassment and persecution that the Ecuadorian government performs against Fundamedios

For over a year and a half, the Ministry of Economic and Social Inclusion (MIES) does not allow the registration of the new directors and Fundamedios partners, which clearly means a violation of the free association right, and the right that has every person to freely associate with anyone of their choice, for legal purposes.

Since October 9th  2012, Fundamedios requested to the MIES the registration of the new directors and the inclusion of a new member for the Foundation, but the Ministry chose not to pass the procedure and gave countless excuses and administrative barriers.

The first barrier was the negative for registering the new member. They said that the director’s period was over and that we had to call to the General Assembly. This order was delivered to the Ministry.

After several months without response to our request, on May 10th, 2013, our attorney met with MIES workers, where we requested a single petition and that was the inclusion of the new member and the registration of the new directive, which was accepted but they told us to re enter it as a new process.

On May 17th, 2013 Fundamedios accomplished with the new requirement while we held another meeting.  This time with the Ab. Francisco Puente, who was responsible for these procedures. He did not submit any remarks on the application.

A month later, June 2013, the Ministry, delaying our process, sent us a letter MIES-CZ-9-2013-2479-OF, requesting:  a) copies of the list of members of the Foundation. b) To accredit the title of journalist for the new partner. The first request was totally absurd because the Ministry is the authority responsible for maintaining the register of FUNDAMEDIOS and therefore should have that information. However, the Ministry justified the request, saying that the records were incomplete because they were transferred to a new file and therefore they did not have that information.

The second request was even more absurd because they wanted that the new partner justifies the title of journalist, claiming an article applicable to affiliates and not to partners.

In the month of June we had a meeting with the lawyer Francisco Puente, to explain to him that we did not have a copy of the list of current members since the MIES never qualified the new member. So we went back to the same situation because the MIES had the «incomplete» records and did not have access to that information either.

We ask for a solution and the second week of August, the lawyer Puente told us that we should deliver a certified copy of the last registered directive with the output of the last partner.

On August 17th the same year, Fundamedios, once again, re entered the documentation and yet, there is no response. We know, from extra official sources that there are superior orders to not process, neither the registration of the new member of the Organization, nor its directive.

Attached to the Law, on December 5th and in the absence of any answer from MIES of receiving any notice from the institution, we entered a final document using as an argument the Article 28 of the State Modernization Law which states that «all claim, request or order of a public authority must be resolved within a period not exceeding fifteen days from the date of filing, unless a statute expressly states other different thing «Therefore we applied the administrative silence to give tacitly accepted our request.

However, few days later, coincidentally, on December 13th, the MIES enforce the administrative control transfer of Fundamedios to the SECOM (Secretariat of Communication), responding to a «request» made ​​in August 2013.

This control transfer was notified to us a month later, on January 16th, after having presented a letter to the MIES, notifying them that the time of administrative silence had passed.

Fundamedios has been constantly attacked and disqualified by top government officials including the President Rafael Correa, as well as the governments media outlets, which have discredited our denounces of violations and restrictions on freedom of expression and association against journalists and citizens.
