El 28 de febrero, el canciller Ricardo Patiño desconoció las competencias de la Comisión Interamericana de Derechos Humanos CIDH al afirmar que “es una ridiculez” que este organismo pida explicaciones al Estado ecuatoriano por la muerte de un ciudadano indígena y anunció que no asistirán a las audiencias convocadas para el 154º Período de Sesiones en la sede de la Comisión.
Durante el Enlace Ciudadano N°413, el Canciller dijo lo siguiente: “La CIDH nos sigue invitando a audiencias generales, para el 17 de marzo estamos invitados audiencias generales (…) No entienden, nos siguen invitando, por la muerte de un compañero indígena, nos llaman para pedirnos explicaciones de eso, o sea es una ridiculez al Estado ecuatoriano para preguntar por qué un dirigente indígena murió, que se están haciendo las investigaciones”.
Tras esto, el presidente Correa le pidió al Canciller que les envíe a los de la CIDH una dosis de “ubicatex, una pildorita de ubicatex”. Término coloquial utilizado para que la gente ocupe su lugar y no se inmiscuya en asuntos que no le corresponden.
En ese sentido el Primer Mandatario se preguntó lo siguiente: “¿Llamaron (la CIDH) al Estado americano por la muerte de los afro estadounidenses asesinados por la policía? ¿Los llamaron alguna vez? Esa es la hipocresía ¿Llamaron alguna vez por la persecución a los de Lengua Noticias? Esa es la hipocresía de esta gente”, concluyó el Jefe de Estado, a lo que el Canciller acotó: “Esa es la situación que vivimos y por eso tenemos que cuidarnos de la injerencia y de la infiltración de los agentes de la CIA” .
Cabe recordar que la Carta de la OEA, ratificada por el Ecuador el 28 de diciembre de 1977, establece a la CIDH como un órgano principal de la OEA, que tiene como función promover la observancia y la defensa de los derechos humanos y servir como órgano consultivo de la Organización en dicha materia. La Convención Americana establece los deberes y obligaciones de los Estados como la de prevenir, investigar y sancionar cualquier violación a los derechos y libertades; derechos protegidos por dicho tratado y declara también que las vías de protección son la CIDH y la CorteIDH, organismos competentes «para conocer los asuntos relacionados con el cumplimiento de los compromisos contraídos por los Estados partes de la Convención».
Chancellor described the IACHR’S invitation to the state to appear at a hearing as “ridiculous”
On February 28, Minister for Foreign Affairs Ricardo Patiño disregarded the powers of the Inter-American Commission on Human Rights IACHR stating that it “is ridiculous” that this body should ask the Ecuadorian State for explanations on the death of an indigenous citizen and announced that they will not attend the hearings convened for the 154th Period of Sessions at the Commission’s headquarters.
During the 413 weekly program Enlace Ciudadano the Minister said: “The IACHR continues to invite us to general hearings, we are invited to the March 17 general hearing (…) They do not understand, they continue to invite us because of the death of an indigenous comrade, they call on us to explain why this happened, it is ridiculous to call on the Ecuadorian State to explain why an indigenous leader died, saying that they are investigating”.
After this, President Correa asked the minister to send the IACHR a dose of “ubicatex, a small tablet of ubicatex”. This is a colloquial term used for people who should keep to their place and not interfere in matters that do not concern them.
The president asked the following: Did they (the IACHR) call on the American State to explain the death of African Americans killed by the police? Did they ever call? It is hypocritical. Did they ever call because of the persecution of the authors of Lengua Noticias? This is hypocrisy”, stated the Head of State, to which the minister added: “That’s the situation we are living and that’s why we have to guard against the interference and infiltration of CIA agents”.
It is worth noting that the OAS Charter, ratified by Ecuador on December 28 1977, establishes the IACHR as one of the OAS main bodies, whose function is to promote the observance and protection of human rights and to serve as an advisory body of the Organization in this matter. The American Convention establishes the duties and obligations of States, such as to prevent, investigate and punish any violation of the rights and freedoms recognized by the Convention; it also states that the means of protection are the IACHR and the I/A Court HR, organs competent “with respect to matters relating to the fulfillment of the commitments made by the States Parties to this Convention”.
