El sábado 07 de enero de 2012, miembros de la policía Judicial y de la Fiscalía clausuraron e incautaron los equipos transmisores de la radio Perla Orense que funcionaba en el cantón el Guabo de la provincia de El Oro, ubicada aproximadamente a 527 km de Quito, al suroeste del País.
Guillermo Serrano, director jurídico de la empresa D’Nany & Services, operadora de la frecuencia 89.5 FM radio Perla Orense y cuya concesión pertenecía a la compañía Bananera Filadelfia SA, cuestionó la legalidad y violencia con la que se ingresó a la estación y se incautaron los equipos. «Los agentes allanaron el lugar a la fuerza rompiendo vidrios, mesas, dieron patadas y golpes y se llevaron las cosas», dijo Serrano.
Esta clausura se dio tras una orden emitida por la Superintendencia de Telecomunicaciones (SUPTEL), argumentando que la radio estaba operando ilegalmente. Esto, a raíz de que el Consejo Nacional de Telecomunicaciones (CONATEL) resolvió, el pasado 24 de septiembre de 2010, mediante oficio RTV 575-18 «revertir al Estado la mencionada frecuencia» debido a una mora superior a seis meses, en el pago correspondiente al arrendamiento de la concesión, de acuerdo con el literal i) del artículo 67 de la Ley de Radiodifusión y Televisión.
Si bien Serrano admitió que la estación cayó en mora porque supuestamente no habían sido notificados para efectuar dichos pagos, aseveró que esta clausura podría representar una represalia contra la emisora, debido a que han sido críticos con el gobierno local y la gestión del actual alcalde del Guabo, Jhon Franco Aguilar, del partido de gobierno, Alianza País. Serrano aseguró, además, que no tenían fundamento legal para su cierre ya que, «al momento que se emitió la resolución de reversión de la frecuencia, ya no debían un solo centavo y la causal no existía», explicó.
Serrano dijo que una vez que se los notificó sobre la deuda, esta fue cancelada de inmediato y adicionalmente, interpusieron una demanda ante el Tribunal Contencioso Administrativo para evitar que se continúe con el proceso de reversión de la frecuencia. El CONATEL ya había rechazado una impugnación anterior presentada por Edwin Arturo Chunzo Hermida, gerente y representante legal de la Bananera Filadelfia.
Para Serrano, es curioso que, en esa provincia, existan cuatro radios más con la concesión revertida al Estado y con demandas ante el Tribunal Contencioso Administrativo que siguen operando y que a ellos les hayan clausurado pese a que los propios funcionarios de la SUPTEL les habían indicado que podían continuar con sus operaciones hasta que se resolviera el caso en el Contencioso .
De su parte, el fiscal de El Oro, Lenin Salinas, dijo en declaraciones para el portal de noticias ecuadorinmediato.com que, en virtud de que la concesión de la frecuencia quedó sin efecto, se procedió a dar cumplimiento con la orden de allanamiento e incautación de los equipos con los que funcionaba la emisora, que fue emitida por el Juez Noveno de Garantías Penales de El Oro.
Roberto Aspiazu, miembro del directorio del CONATEL dijo a FUNDAMEDIOS que la ley es clara respecto a la reversión de una frecuencia por mora en los pagos. Sin embargo aseguró, sin precisar nombres, que conoce de algunos casos de radios que continúan funcionando pese a que se han revertido sus frecuencias.
Judicial police and prosecutor’s office close down radiostation and seize its equipment
On Saturday 7 January 2012, members of the Judicial Police and the Prosecutor’s Office closed down radio station Perla Orense and seized its broadcasting equipment. The station operated in the Guabo canton in the province of El Oro, located approximately 527 km from Quito in southwestern Ecuador.

The closing down followed an order issued by the Superintendence of Communications (SUPTEL), which stated that the station was operating illegally.This took place after the National Telecommunications Council (CONATEL) resolved on 24 September 2010, through official document RTV 575-18 “to return the frequency in question to the State” because of a longer than six months delay in payments corresponding to the rent of the concession, according to item i) of article 67 of the Broadcasting and Television Law.
Although Serrano admitted that the station had not paid, allegedly because it had not been notified about the payment dates, he stated that the closing down could be a reprisal against Perla Orense. The station has maintained a critical stance against the local government and the administration of the current mayor of Guabo, Jhon Franco Aguilar, member of the government party Alianza País.Serrano also maintained that there were no legal grounds for closing down the station because “at the time when the resolution to return the frequency to the State was issued, we no longer owed any money, so the grounds did not exist anymore».
Serrano said that once they received notice of the arrears, they paid immediately and even filed a suit before the Administrative Contentious Tribunal to prevent the frequency reversion process from continuing.CONATEL had already rejected a previous impugnation presented by Arturo ChunzoHermida, manager and legal representative of BananeraFiladelfia.
Serrano believes it is curious that in this province four other radio frequencies have reverted to the State and have filed lawsuits before the Administrative Contentious Tribunal but continue to operate, while they have been closed down even though SUPTEL officials had told them that they could continue broadcasting until the Contentious case was resolved.
On the other hand, the prosecutor of El Oro, Lenin Salinas, declared to the news portalecuadorinmediato.com that, because the frequency’s concession was no longer in effect, they proceeded to comply with the order to occupy the radio station and seize its equipment, as issued by the Ninth Penal Guarantees Judge of El Oro.
Roberto Aspiazu, a member of CONATEL’s board of directors, told FUNDAMEDIOS that the law is clear concerning the reversion of frequencies when there is delay in payments.He stated, however, without giving any names, that he knows cases of stations that continue to operate despite the reversion of their frequencies.
