El 18 de diciembre de 2014, la Superintendencia de la Información y Comunicación (Supercom) ordenó a diario La Hora pedir disculpas y publicar un pedido de rectificación solicitado por el medio en manos del Estado Gama TV, por considerar que el rotativo infringió el inciso segundo del artículo 23 de la Ley Orgánica de Comunicación, al no atender con las mismas características, dimensiones y en el mismo espacio, sección u horario el pedido del medio estatal.
Esta sanción responde a una denuncia presentada por el canal en manos del Estado, tras la publicación de una nota titulada “Gama-TV tiene contenido discriminatorio según Supercom”, publicada por el periódico el pasado 8 de octubre, sobre la base de un informe preliminar emitido por la entidad de control respecto al avance de los medios en el cumplimiento de la Ley.
Por esta nota, el 13 de octubre, Gama TV pidió al medio impreso ejercer su derecho a réplica y rectificación. Sin embargo, según la defensa del medio incautado, pese a que diario La Hora publicó al día siguiente el texto remitido por ese canal, lo hizo bajo el título “réplica” y el subtítulo “Gama TV critica publicación de La Hora sobre estudio de Supercom”, lo que a criterio del denunciante confunde al lector y da a entender que Gama TV es un incumplidor de la Ley.
Por su parte, el abogado de diario La Hora, Gerardo Aguirre, señaló durante la audiencia de sustanciación que el rotativo sí cumplió con el derecho a la réplica solicitado por la estación televisiva y que nota difundida se basó en un informe preliminar emitido por la misma Superintendencia acerca del cumplimiento que han tenido los medios a partir de la vigencia de la LOC, por lo que fue un hecho real .
Para la entidad de control, el diario no observó los presupuestos de verificación, contrastación y contextualización de la noticia, así como tampoco atendió la solicitud de rectificación presentada por Gama TV, pues si bien publicó el contenido íntegro de la carta remitida por el canal incautado; lo hizo únicamente como réplica, y no incluyó el título “rectificación” o “corrección”. En ese sentido, la Supercom también afirmó que el medio desnaturalizó el contenido de la réplica y rectificación solicitadas al publicar un subtítulo junto a dicha carta.
Journal should apologize and rectify complaint after half seized by the government

Meanwhile, the lawyer for the newspaper La Hora, Gerardo Aguirre, said during the hearing that the rotary conduct did comply with the right of reply requested by the television station and broadcast rating was based on a preliminary report issued by the same supervision on compliance that have the means from the effective date of the LOC, so it was a real event.
