El 4 de diciembre de 2014 diario Expreso publicó, en su portada y primera página interior, una rectificación ordenada por la Superintendencia de la Información y Comunicación (Supercom) de una nota periodística referente a una supuesta pérdida de la Refinería del Pacífico que, a criterio de la entidad de control, no fue publicada en las características y dimensiones señaladas por la Ley. Por esta misma nota, el rotativo ya fue sancionado el pasado 25 de noviembre, con una multa equivalente al 2% de la facturación promediada de los últimos tres meses, por considerar que el medio tomó posición institucional sobre asuntos judiciales.
En la rectificación publicada por el medio de comunicación se afirmó que la nota publicada por el rotativo “contiene evidentes y flagrantes errores que desinforman a la ciudadanía, con criterios falsos” y se rechazó la posible existencia de un perjuicio al Estado.
La sanción y posterior orden de rectificación se originó por una nota periodística, publicada el pasado 20 de octubre, titulada “Refinería del Pacífico pierde USD 29,3 millones” y sustentada en informes oficiales de Contraloría. El gerente de dicha empresa estatal, Bismarck Andrade, solicitó una rectificación que fue publicada el 23 de octubre. Pese a ello, días más tarde, Andrade denunció a diario Expreso ante la Supercom por presunta infracción a los artículos 23 y 25 de la Ley, los mismos que posteriormente se utilizaron para sancionar al medio. La Supercom determinó que si bien el medio de comunicación publicó la rectificación, esta, en comparación con la nota original, “es poco visible” y “no fue publicada en forma proporcional al espacio y efectos visuales que se utilizaron en la portada de la edición del 20 de octubre”. Por ellos la entidad de control consideró que el medio incumplió el artículo 23 de la LOC, referente a la obligación de los medios de rectificar en el mismo espacio o sección dentro de 72 horas. La Superintendencia concluyó además que el diario tomó posición institucional sobre asuntos judiciales e incumplió con el artículo 25 de la Ley porque difundió una noticia periodística basada en un informe de la Contraloría General del Estado.
En una nota adjunta de la redacción y otra firmada por el abogado del medio de comunicación, se explicó el “riguroso” proceso que se siguió para la elaboración de la nota periodística en mención y se aseguró que el pedido de rectificación solicitado era improcedente, pues según la defensa del periódico, “La Ley de Comunicación manda claramente a que la Superintendencia de la Información y Comunicación determine la pertinencia del reclamo”, por lo que el medio presentó un recurso de Reposición, a fin de que la entidad de control revise su decisión .
Esta es la segunda rectificación que Expreso se ve obligado a publicar por orden directa de la Supercom. El pasado 25 de noviembre, el rotativo fue obligado a publicar una rectificación bajo los términos impuestos por la Supercom por una noticia referente a una sanción impuesta a diario Extra. Por ese caso el medio había denunciado en sus páginas el insólito hecho que la nota, o pedido de rectificación haya llegado a la redacción armada y titulada, utilizando tipos de letra y una diagramación que no guarda relación con el estilo gráfico del periódico.
Newspaper is obligated to publish a disclaimer in its front page
On December 4, 2014 Daily newspaper El Expreso published on its cover and inside at the first page, an orderly ratification by the Superintendence of Information and Communication (SuperCom), the news report was regarding an alleged loss of the Pacific Refinery, which according to the control entity, was not published whit the characteristics and dimensions specified by the Law.
For this note, the newspaper was already sanctioned last November 25, with a fine equivalent to the 2% of the average turnover of the last three months; the fine was for considering that the media took institutional position on judicial matters.
In the ratification published by the communication media it was stated that the article published by the newspaper «contains obvious and flagrant errors that misinform the public with false criteria» and was rejected the possible existence of an injury to the State.
The sanction and subsequent rectification order were originated because of a newspaper article, published last October 20, entitled «Pacific Refinery lost USD 29.3 million» and supported with official reports from the Comptroller. The Refinery’s manager, Mr. Bismarck Andrade, requested a ratification which was published on October 23. Nevertheless, days later, Mr. Andrade field a denounce to newspaper Expreso before the SuperCom for alleged infringement of Articles 23 and 25 of the Communication Law, the same articles that later were used to punish the media. The SuperCom found that is correct that the media published the mentioned ratification, this one compared to the original note, «is not that visible» and «was not published in proportion to the space and visual effects that were used on the cover of the October 20 issue «. For that reason the control entity considered that the media breached Article 23 of the LOC concerning the media obligation to rectify in the same space or section within 72 hours. The Superintendence also concluded that the newspaper took institutional position on judicial matters and breached Article 25 of the LOC because it published a news story based on a report made by the General Comptroller.
In an accompanying editorial note and another signed by the media counsel, was explain the «rigorous» process for the preparation of the newspaper article in question and confirmed that the ratification order requested, was inappropriate, because according to the newspaper defense, «The Communication Law clearly mandates that the Superintendence of Information and Communication determine the relevance of the claim» therefore the media appealed for reconsideration, expecting the controlling entity review its decision.
This is the second rectification newspaper Expreso is forced to publish for direct orders from the SuperCom. On November 25, the newspaper was forced to publish a rectification under the terms imposed by the SuperCom, because of a story concerning a penalty imposed on newspaper Extra. Because of that case the media had reported in its pages the unusual fact that the note or request for rectification has reached the newspaper editorial offices titled, using fonts and layout that is unrelated to the newspapers’ graphic style.
