El 21 de Diciembre de 2015, la Superintendencia de la Información y Comunicación (Supercom), a través de un proceso iniciado de oficio, sancionó con una amonestación escrita a Diario Extra por inobservar la norma deontológica establecida en el artículo 10, numeral 3, literal d) de la LOC, que se refiere al ejercicio profesional, en el que se establece la obligación de “evitar un tratamiento morboso a la información sobre crímenes, accidentes, catástrofes u otros eventos similares”. La sanción se origina en los titulares “Plomo en medio de chateo” y “Acribillado dentro del automóvil”, del 1 de octubre de 2015.
La Superintendencia determinó que “el tratamiento periodístico fue morboso al publicar fotografías y textos que revictimizan al ser humano, que en este caso fue víctima de asesinato, y que tiene el derecho a que su dignidad y la de su familia no sea menoscabado, ni conculcado durante el ejercicio de la actividad periodística de los medios de comunicación. Si bien diario Extra informó sobre acontecimientos reales que sucedieron y que produjeron la atención de la ciudadanía por lo que, al parecer de la Supercom, el Diario desconoció su responsabilidad social”, apuntó la entidad en su reporte.
El 10 de diciembre de 2015 durante la audiencia de sustanciación, Johnny de la Pared representante del medio, rechazó el reporte interno asegurando que “la publicación no adoleció de ningún incumplimiento a la ley, menos aún de un tratamiento morboso a la información”. De la Pared cuestionó a quienes elaboraron el documento, asegurando que “son inminentemente opiniones personales respetables y que no ostentan ninguna calidad de medicina, ni de psiquiatría para valorar si efectivamente una situación determinada en este caso la publicación es morbosa”. Para finalizar añadió que “al utilizar un titular con un fondo negro o letras amarilla despierta la atención de quien va a comprar el periódico; sin embargo, se difuminó la cara de la víctima, hecho que fue observado y advertido en un proceso anterior en contra del periódico” .
Por su parte el representante de la Supercom Alejandro Salguero ratificó el contenido del reporte interno el cual señala que “el medio expuso un caso de violencia, en el que usó imágenes dramáticas, sin considerar la dignidad de la víctima y de su familia, al exhibir en forma cruda un crimen”. Presentó como prueba el informe técnico elaborado también por la Supercom.
Newspaper is sanctioned because of «morbid» treatment of news about murder
On 21 December 2015, the Superintendency of Information and Communication (Supercom), through a process initiated ex officio, cautioned in writing Diario Extra because of an alleged breach of the ethical standard set in Article 10, paragraph 3, letter d) of the LOC, which refers to professional practice and establishes the obligation of «avoiding the morbid treatment of information about crimes, accidents, catastrophes or other similar events». The sanction was brought on by the headlines «Lead while chatting» and «Riddled with bullets inside the car», published on October 1, 2015.
The Superintendency determined that «the journalistic treatment was morbid because photographs and texts were published that re-victimized the human being, which in this case was the victim of murder, and is entitled to keep his dignity and his family’s from being undermined or violated during the exercise of the media’s journalistic activity». Although Extra reported on actual events that grabbed the public’s attention, according to Supercom, «the newspaper ignored its social responsibility», as stated in its report.
On 10 December 2015, during the substantiation hearing, Johnny de la Pared, representative of the media outlet, rejected the internal report asserting that «the publication did not suffer from any breach of the law, still less from a morbid treatment of the information». De la Pared questioned those who drafted the document, ensuring that «these are imminently respectable personal opinions, which are not based on medicine, or psychiatry, to assess whether indeed in this case the publication was morbid». Finally he added that «using a headline with a black background or yellow writing arouses the attention of those who will buy the newspaper; however, the victim’s face was blurred, a fact that was noted and observed in a previous process against the newspaper».
Meanwhile, Supercom’s representative, Alejandro Salguero, confirmed the contents of the internal report, which points out that «the media outlet presented a case of violence, using dramatic images without regard to the dignity of the victim and his family by displaying a crime in a crude manner». He presented as evidence the technical report also elaborated by Supercom.
