El 21 de enero de 2014, la Superintendencia de la Información y Comunicación (Supercom) emitió una amonestación escrita contra radio “Novedades”, de Latacunga –ciudad ubicada a 60Km al sur de Quito- y el periodista Patricio Viera, conductor del programa “Corrientes de opinión ciudadana”, quien fue conminado por el ente de control a “abstenerse de reincidir en el cometimiento de actos que vayan en contra de lo que estipula la ley”. La sanción se dio tras denuncia del Gobernador de Cotopaxi, quien alegó que fue desacreditado en varias ocasiones.
La entidad de control concluyó que “las opiniones vertidas por el conductor del programa ‘Corrientes de Opinión Ciudadana’, difundido los días 25 y 30 de septiembre, y 1 y 3 de diciembre de 2014, no afectaron la honra y la reputación del accionante; sin embargo, se constató que con las opiniones transcritas y difundidas por el medio de comunicación accionado, el señor Patricio Viera, tergiversó intencionalmente algunos de los elementos de la información que transmitió respecto a algunos temas coyunturales y de la gestión de algunos funcionarios de la provincia”.
En ese sentido, la Supercom afirmó que el medio y el periodista inobservaron la norma deontológica contenida en el artículo 10, numeral 3), literal b) de la Ley Orgánica de Comunicación (LOC) referente a la obligación de abstenerse de “omitir y tergiversar intencionalmente elementos de la información u opiniones difundidas”.
Esta sanción responde a la denuncia planteada el pasado 30 de diciembre por Fernando Suárez, Gobernador de la Provincia de Cotopaxi. En el escrito, el funcionario alegó que se incumplió con el artículo 10 numeral 1, literal a); numeral 3), literal b); y, numeral 4 literal j) de la LOC, referentes al respeto a la honra; el abstenerse de tergiversar la información y de cometer prácticas de linchamiento mediático.
En la audiencia de sustanciación, la defensa del gobernador aseguró que el periodista emitió opiniones con el único fin de desacreditar al Gobernador y a los funcionarios de la entidad pública y afectando su honra.
En diálogo con Fundamedios, Viera rechazó estas acusaciones y aseguró que la denuncia no tenía “ni pies ni cabeza” pues lo único que hizo es emitir críticas generales a la gestión del Gobierno y pedir que cumplan con los ofrecimientos de obras para la provincia, sin mencionar en ningún momento al Gobernador, ni por su cargo ni por su nombre. Viera añadió que existe una total intolerancia y con este precedente cualquier crítica al Gobierno puede ser asumida de forma personal por los funcionarios públicos .
Viera aseguró que no apelará esta decisión, pero que desde ahora va a tener que pensar muy bien antes de emitir una opinión crítica con las autoridades. “A uno le hace reflexionar, uno es empleado y de ninguna manera puede poner en riesgo la integridad de la radio. La sanción es una forma de demostrar que no se puede comentar con tranquilidad en ciertos temas de la provincia y lo que atañe a las autoridades públicas. Habrá que pensar mil veces antes de hacer un comentario. Sin embargo, sí vamos a mantener una línea crítica cuando se hagan las cosas mal.
Radio station is sanctioned for making statements against the government
On January 21st 2015, Information and Communication Superintendence (Supercom for its acronym in Spanish) issued a written sanction against Radio “Novedades”, from Latacunga –city located 60Km to the south of Quito- and journalist Patricio Viera, host of the program “Currents of citizen opinion”, was ordered by the control institution to “abstain from repeating in committing acts that go against what is stated in the Law”. The sanction occurred after the claim of Cotopaxi’s Governor, who argued that he was diminished on several occasions.
The control institution concluded that “opinions given by the program “Currents of citizen opinion” host, broadcasted on September 25th and 30th and on October 1st and 3rd 2014, did not affect the honor and reputation of the petitioner; nonetheless, it was proven that opinions given through the involved radio station, mister Patricio Viera, distorted intentionally some elements of the broadcasted information regarding current issues and some provincial officials work”.
With this in mind, Supercom asserted that the radio station and the journalist failed to apply the deontological norm in article 10, number 3), section b) of the Communication Law referring to the obligation of refraining from “leaving out and intentionally distorting elements of broadcasted information or opinions”.
This sanction answers to the claim file don December 30th 2014, by Fernando Suárez, Governor of Cotopaxi Province. In the written claim, the provincial official pointed out that the omission corresponded to article 10, number 1, section a),; number 3, section b) and number 4, section j) of the Communication Law, referring to respecting the honor; refraining from distorting information and committing media lynching practices.
During the conduct hearing, the Governor’s defense assured that the journalist gave opinions aiming to diminish him and public officials of the public institution he leads, affecting their honor.
In a dialogue with Fundamedios, Viera rejected these accusations and assured that the claim against him had “no feet nor head” because the only thing he did, was to criticize the Government in a general way and request for them to deliver campaign offerings in the province, without mentioning the Governors name nor his public function at any given moment. Viera added that there is total intolerance and with this precedent any criticism against the Government can be assumed in a personal manner by public officials.
Viera assured he will not appeal this decision, but that from now on he will have to think very well before making any comments or critical opinions regarding any public official. “One reflects, since I am an employee and by any chance can risk the integrity of the radio. This sanction is a way of demonstrating that you cannot peacefully comment about some issues in the province and what regards public officials. I will have to think a thousand times before commenting. Nonetheless, we are going to maintain a critical line when things are wrongfully done.”
