El 18 de agosto de 2011, el juez de la Segunda Sala de lo Penal de la Corte de Justicia del Guayas, Eduardo Guerrero Mórtola fue suspendido por el Consejo de la Judicatura de Transición. El mencionado juez estaba a cargo de la apelación a la sentencia en la querella interpuesta por el presidente Rafael Correa contra diario El Universo, tres de sus directivos y el ex editor de Opinión, Emilio Palacio. Con él suman un total de siete magistrados que se han hecho cargo de este proceso, entre primera y segunda instancia.
Guerrero explicó que su suspensión se dio supuestamente porque no había fundamentado debidamente una sentencia en otro caso. En su reemplazo, la Dirección Provincial de la Judicatura designó a Stevie Raúl Gamboa Valladares, quien habría accedido al cargo mediante un sorteo.
Sin embargo, este cambio generó el rechazo de la defensa de diario El Universo, quienes aseguraron que el nuevo juez Gamboa ha sido designado sin haber cumplido el requisito de tener por lo menos 7 años de ejercicio profesional y, además, es cercano al abogado de la parte acusadora, Alembert Vera ya que ambos pertenecen a la misma promoción de graduados en la Universidad Católica de Guayaquil. De hecho, la prensa publicó fotografías en las que el abogado de Rafael Correa y el nuevo juez Gamboa aparecen abrazados en una fiesta.
Esto último fue rechazado por Vera, quien afirmó que las fotos no demuestran nada y que El Universo ha pasado de ser «un periódico serio, a una revista de chismes» .
En la querella por injurias planteada el presidente Rafael Correa, un juez temporal sentenció a tres años de prisión a los directivos del diario y su ex editorialista, así como el pago indemnizatorio de $40 millones, en total.
Cabe recordar que el proceso, por el que, hasta el momento han actuado cinco jueces, en primera instancia y dos en segunda ha sido cuestionado por que entre otras cosas, recibió «un veloz trámite» (cuatro meses) en manos de cinco jueces distintos y que la sentencia también fue dictada en tiempo récord por un juez temporal quien aseguró públicamente que trabajó hasta las 05:00 de la mañana, el mismo día de la audiencia final, para dictar la sentencia.
Trial against newspaper El Universo to be seen by seventh judge and defense questions his independence
On 18 August 2011, the judge of the Second Criminal Division of the Guayas Court of Justice, Eduardo Guerrero Mórtola, was suspended by the Transitional Judicature Council.The judge was in charge of the appeal against the sentence in the lawsuit filed by President Rafael Correa against the newspaper ElUniverso, three of its directors and its former opinion editor, Emilio Palacio.The new judge would be the seventh in charge of this process in the first and second instance.
Guerrero explained that he was suspended because he had allegedly not provided proper justification for a sentence in a different case.The Judicature Provincial Administrative Council designated Stevie Raúl GamboaValladares as his replacement, allegedly through a draw.
This change, however, generated the rejection of El Universo’s defense who argued that the new judge, Gamboa, has been designated without complying with the requisite of having at least 7 years’ professional experience, plus he is close to Alembert Vera, one of the plaintiff’s lawyers, because they both studied in the same promotion of the Catholic University of Guayaquil.In fact, the paper published photographs in which Rafael Correa’s lawyer and judge Gamboa are hugging each other at a party.
This was rejected by Vera, who stated that the photographs prove nothing and that El Universo has gone from being «a serious newspaper to a gossip magazine».
In the lawsuit for slander filed by President Rafael Correa, a temporary judge issued a three year prison sentence against the newspaper’s directors and its former editorial writer, as well as ordering the payment of a total of $40 million in damages.
It is worth remembering that the process, in which so far five first instance and two second instance judges have intervened, has been questioned because, among other things, it was «processed quickly» (four months) by five different judges and the sentence was also issued in record time by a temporary judge who stated publicly that he worked until 5:00 am on the same day of the final hearing to issue the sentence.
