El 03 de agosto de 2011, organizaciones sociales calificadas para hacer campaña a favor de las tesis del Gobierno en la consulta popular y referéndum del pasado 07 de mayo, informaron que denunciarán a la revista Vistazo por supuestamente haber violado el silencio electoral, al publicar un editorial en la que expusieron su posición por el No en varias preguntas de la consulta.
De acuerdo a un comunicado público enviado por: la Corporación de Desarrollo Agrícola Ñukanchi Allpa,; la Confederación Nacional del Seguro Campesino y Coordinadora Nacional Campesina; la Asociación Agropecuaria de Pueblos y Nacionalidades Indígenas Migrantes Sumak Tarpuy Ayllukunapak y la Organización Popular de Izquierda Radical Diabluma denunciarán a Vistazo porque la «revista generó una competencia desleal y desigual que indujo abiertamente el voto negativo en el electorado el momento de ejercer su derecho al voto».
Esta denuncia se suma a la de Víctor Raúl Ocaña García, presidente de la Cámara Bolivariana de Economía Solidaria, otra orgazanización cercana al Gobierno, quien el pasado 20 de junio demandó al medio ante el Tribunal Contencioso Electoral con el argumento de que Vistazo incurrió en una supuesta infracción electoral al violar el silencio de 48 horas que, por ley, se debe respetar antes de un proceso de elecciones, tras publicar el editorial que ahora es cuestionado por las organizaciones mencionadas.
El editorial titulado «Un no rotundo» fue publicado por Vistazo el pasado 04 de mayo en su edición No 1049 en donde se da a conocer la posición del medio y se ofrece un análisis de los motivos para votar No en las preguntas 3, 4, 5 y 9 de la consulta, relacionadas con los cambios en el sistema judicial, las limitaciones en la propiedad y en la difusión de contenidos en los medios .
Patricia Estupiñán, editora general de la revista Vistazo aseguró, en una entrevista anterior con Fundamedios, que lo publicado fue un editorial y que, por lo tanto, no han violado la ley electoral ya que no hicieron propaganda de ningún tipo.
Cabe recordar que el pasado 04 de junio, el presidente Rafael Correa durante su Enlace Ciudadano No 223 ya advirtió de que la revista habría incursionado en lo que él llamó una «descarada infracción electoral» que deberá ser multada.
Hasta el momento, el Tribunal Contencioso Electoral aún está tramitando la denuncia planteada por Ocaña bajo el número de causa 794-2011.
Social organizations join denunciation against magazine for alleged electoral infraction
On 3 August 2011, social organizations designated to campaign in favor of the government’s thesis during the popular consultation and referendum of 7 May, reported that they will denounce Vistazo magazine for allegedly infringing the electoral silence by publishing an editorial in which it made clear its preference for the NO option in several of the consultation’s questions.
According to a public notice sent by:the Agricultural Development Corporation ÑukanchiAllpa; the National Confederation of Rural Insurance and National Peasant Coordinating Committee; the Farming Association of Migrant Indigenous Peoples and Nationalities SumakTarpuyAyllunkunapak and the Radical Left Popular Organization Diabluma, will denounce Vistazo because the «magazine generated disloyal and unequal competition that openly induced the electorate to vote negatively at the moment of exercising its right to vote».
This denunciation is added to the one issued by VíctorRaúlOcañaGarcía, president of the Bolivarian Solidary Economy Chamber, another organization that is close to the government, who on 20 May filed a lawsuit against the magazine before the Electoral Contentious Tribunal arguing that Vistazo incurred in an alleged electoral infraction by infringing the 48 hour silence that, by law, must be respected before an electoral process, after publishing the editorial that is now questioned by the former organizations.
The editorial «Un no rotundo» was published by Vistazo in its 1049 edition on 4 May, stating the magazine’s position and analyzing the motives for voting No for questions 3, 4, 5 and 9 of the consultation,which were related to changes in the judicial system, limits on property and the diffusion of contents by the media.
Patricia Estupiñán, Vistazo magazine’s general editor, asserted in a previous interview with Fundamedios that the article was an editorial and that, therefore, they did not infringe the electorallaw because they were not making propaganda of any kind.
It is worth remembering that on 4 June, President Rafael Correa, during his 223 Enlace Ciudadano program, had already warned that the magazine had incurred in what he called a «shameless electoral infraction» that should be fined.
The Contentious Electoral Tribunal is currently processing the denunciation filed by Ocaña under case number 794-2011.
