El 7 de diciembre de 2015, la Intendencia de la Información y Comunicación Zonal 6, mediante un trámite iniciado de oficio, sancionó a radio La Voz del País (96.1 FM) de Cuenca con USD 708 equivalentes a dos salarios mínimos por infringir el segundo inciso del artículo 60 de la Ley Orgánica de Comunicación (LOC), que señala la obligación que tienen los medios de clasificar sus contenidos. La multa se dio tras la difusión de un segmento de concurso denominado “mejor piropo al artista Romeo Santos” en el programa “Terapia intensiva”, en donde los oyentes participaron a través de llamadas telefónicas. Sin embargo, para la Supercom, las expresiones vertidas por estos “no reunieron los parámetros jurídicos y técnicos para que su contenido pueda ser clasificado como “E” de entretenimiento”.
El 23 de noviembre de 2015, durante la audiencia de sustanciación, el abogado defensor aseguró que el medio de comunicación atraviesa un período de transición que implica adoptar cambios y mejoras en la calidad de la programación, por lo que pidió que el incidente se tome como un hecho aislado y que la resolución que adopte la Intendencia la deja a consideración de la autoridad .
Por su parte, el Director de Prevención e Intervención Jurídica de la Intendencia Zonal 6 indicó “que el medio de comunicación no se refirió ni presentó pruebas de descargo sobre los hechos que se le imputaban”. Recordó que las resoluciones que expide la entidad son de obligatorio cumplimiento, siendo responsabilidad del medio clasificar, identificar y determinar las franjas horarias de acuerdo con el artículo 60 de la LOC, de ahí que el contenido del segmento no se adecuó a los parámetros jurídicos y técnicos del artículo 9, literal d) de la resolución CORDICOM-PLE-2014-031, que define lo que se considera como un contenido de entretenimiento.
Radio station is fined because of listener’s comments during contest
On December 7, 2015, the Intendency for Information and Communication for Zone 6, in a process initiated ex officio, fined radio station La Voz del País (96.1 FM) from Cuenca USD 708, equivalent to two minimum wages, for infringing the second paragraph of Article 60 of the Organic Communication Law (LOC), which establishes the media’s obligation to classify their contents. The fine was issued after the broadcast of a contest segment called «Best compliment for the artist Romeo Santos» during the program «Terapia intensiva», where listeners participated through telephone calls. However, for Supercom, the listeners’ statements «did not meet the legal and technical parameters so that their content could be classified as «E» for entertainment».
On November 23, 2015, during the substantiation hearing, the defense attorney stated that the station is going through a period of transition that involves adopting changes and improvements in the quality of its programming, and therefore requested that the incident be taken as an isolated event, and asked the authority to consider its resolution.
Meanwhile, the Director of Prevention and Juridical Intervention of the Intendency for Zone 6 claimed that «the media outlet did not mention or present exculpatory evidence for the events it was accused of». He reminded everyone that the resolutions issued by the entity are mandatory, and that it is the media’s responsibility to classify, identify and determine time slots in accordance with Article 60 of the LOC, which is why the content of the segment did not comply with the legal and technical parameters of Article 9, paragraph d) of CORDICOM-PLE-2014-031 resolution, which defines what is considered as entertainment content.
